§1. General provisions

1. These terms and conditions define the rules for issuing and using gift cards (hereinafter: the “Gift Card” or “Voucher”) offered by Surf Inc, with its registered office in Kraków, ul. Ks. Stanisława Truszkowskiego 32A, 31-352 Kraków, VAT ID: 9592006709 (hereinafter: the “Seller”).
2. The Gift Card is a means of payment entitling the holder to pay for goods or services offered by the Seller.
3. The Purchaser and the User of the Gift Card accept the provisions of these Terms and Conditions.

§2. Types of Gift Cards

1. The Seller offers Gift Cards:
   a) in physical (paper) form,
   b) in electronic (email) form.
2. The Gift Card may have a nominal value determined by the Seller or indicated by the Purchaser, if the Seller allows such an option.

§3. Purchase of Gift Cards

1. Gift Cards can be purchased in the physical store or online, if the Seller provides such an option.
2. The purchase of a Gift Card is completed after full payment has been made.
3. The purchase of a Gift Card is not subject to discounts, promotions or loyalty programs, unless the Seller decides otherwise.
4. The purchase of a Gift Card is non-refundable.
5. The Gift Card is assigned to the country of purchase and may be redeemed only within that country. Redeeming the Gift Card in a country other than the country of purchase is not allowed.

§4. Rules for using Gift Cards

1. The Gift Card may be used only for goods or services offered by the Seller in the country where the Gift Card was purchased.
2. The Gift Card cannot be exchanged for cash, in whole or in part.
3. If the value of the purchase exceeds the value of the Gift Card, the User must pay the difference.
4. If the value of the purchase is lower than the value of the Gift Card, any unused funds are forfeited and cannot be used for further purchases.
5. The Gift Card is single-use and may be used only in one transaction.

The Seller may refuse to redeem the Gift Card if:
a) the validity period of the Gift Card has expired,
b) the Gift Card is damaged and the data cannot be read,
c) there is a reasonable suspicion that the Gift Card is forged.

§5. Validity period

1. The Gift Card is valid for 12 months from the date of purchase, unless stated otherwise on the Gift Card.
2. After the expiry of the validity period, the Gift Card expires and any unused funds are forfeited and are not refundable.

§6. Seller’s liability

1. The Seller is not liable for lost, stolen or destroyed Gift Cards after they have been handed over to the Purchaser.
2. The Seller does not issue duplicates of Gift Cards, unless an individual decision is made.
3. The Seller is not responsible for Gift Cards purchased from unauthorised sources.

§7. Complaints

1. Complaints concerning Gift Cards should be sent by email to SUPPORT@SURF.INC or in writing to the Seller’s registered office address.
2. The complaint should include a description of the reported issue and the contact details of the person submitting the complaint.
3. The Seller will review complaints within 14 days of their receipt.

§8. Personal data

1. In the case of purchasing a Gift Card online, the Seller may process the Purchaser’s personal data in accordance with applicable law.
2. Detailed information on data processing is provided in the Seller’s Privacy Policy.

§9. Final provisions

1. These Terms and Conditions are available in the physical store and on the Seller’s website.
2. The Seller reserves the right to amend these Terms and Conditions. Any changes become effective upon publication.
3. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other applicable laws shall apply.
